Asaram rape case witness Rahul Sachan stabbed in court premises

New Delhi/Jodhpur: In yet another attack on the witness of the Surat rape case against controversial 'godman' Asaram, Rahul Sharma alias Rahul Sachan alias 'Laptop Baba' was on Friday attacked by unidentified man with a knife in Jodhpur court premises.

According to reports, Sachan was immediately rushed to a nearby hospital. Meanwhile, police said that they have arrested the attacker.

Last month, Akhil Gupta, another witness in the said case and former driver and cook of Asaram was shot dead by unidentified persons in Uttar Pradesh's Muzaffarnagar.

He was shot dead on Jansath Road under New Mandi police station area in Muzaffarnagar on his way back home by unidentified assailants.

Gupta had given statement before a Gandhinagar Court under section 164 of CrPC along with some incriminating proof against Asaram, who is accused of sexually assaulting a 16-year-old schoolgirl.

The Supreme Court, later, declined a plea for bail by self-styled godman Asaram Bapu.

Earlier, in the chargesheet filed on January 9, 2014, before Chief Judicial Magistrate, Gandhinagar, the Gujarat Police had named Asaram, his wife Lakshmi, daughter Bharti and four of his followers, Dhruvben, Nirmala, Jassi and Meera, for “hatching a conspiracy”, “illegal confinement” and “rape”.

Later, the Ahmedabad police listed 101 witnesses, of whom two, Akhil Gupta and Amrut Prajapati, are now dead. Three others related to the case have survived attacks. However, the SIT officials claim that since the murders took place after the chargesheet was filed, these would not affect the case.

The 72-year-old Asaram, who is currently lodged in Jodhpur jail, was arrested after a 16-year-old girl lodged a police complaint August 20, 2013, accusing him of sexually assaulting her at his ashram in Jodhpur.

Asaram was arrested in September 2013. He is being tried under the provision of Protection of Children from Sexual Offences Act (POCSO).

AAP govt to pursue corruption charges against Sheila Dikshit, Mukesh Ambani, Veerappa Moily

New Delhi: Delhi's AAP government to be sworn in tomorrow will pursue allegations of corruption against ex-Chief Minister Sheila Dikshit and industrialist Mukesh Ambani and others, Deputy Chief Minister-designate Manish Sisodia said on Friday. All the cases that were registered last year during Kejriwal government's 49-day stint "will be pursued", Sisodia said.

Sisodia, who had been asked whether the FIRs lodged by the AAP government last year against Mukesh Ambani, the then Petroleum Minister M Veerappa Moily as also allegations against Dikshit would be pursued, responded "yes, definitely".

The then Chief Minister Arvind Kejriwal had ordered filing of an FIR on February 11 last year against Moily, his predecessor Murli Deora, who is dead now, and RIL Chief Mukesh Ambani for alleged collusion in hike of prices in natural gas from the KG basin. The then AAP government had also ordered a probe into street light purchase scam during the Commonwealth Games of 2010 in which Dikshit's role had come under the scanner.

Sisodia said the AAP government will "revive" the cases that have been put in cold storage and take them to a "logical conclusion". On its key poll promise of slashing power tariff by 50%, Sisodia said it would be done "as soon as possible".

Alleging wide-spread corruption in the power sector, Sisodia said the new government would force the power distribution companies to give all their financial details to the CAG that is probing their accounts. The CAG audit into the finances of the private power distribution companies was ordered by the Kejriwal government last year.

In its manifesto, AAP had promised to cut power tariff by 50% immediately after coming to power and said the rates will be revised based on the findings of the CAG audit. "CAG audit into the discoms is already going on. We will force them to give all the details to the CAG," Sisodia said.

Sisodia said the AAP government will also soon announce 20 kilolitres (20,000 litres) of free water to every household per month as per its promise. The previous AAP government had introduced the free water scheme but it was discontinued after it quit. "We will bring back the free water scheme which was discontinued after we quit the government as water is basic right," he said.

Asked how the new AAP government will tackle the 'VIP culture' of 'lal battis', he said "all the Ministers will ride ordinary cars".

"Not even the Chief Minister will use red-beacon or hooters on his official car. The AAP government will be a government of simplicity. The Ministers may avail government accomodation but not huge bungalows. They will take normal salary and will not travel with huge security contingents," he said.

Gulbarg fund case: SC stays arrest of Teesta Setalvad till February 19

New Delhi: Supreme Court on Friday deferred the hearing on the anticipatory bail plea of social activist Teesta Setalvad till February 19, in a case of alleged embezzlement of funds for a museum at Gulbarg society, devastated in the 2002 riots.

The court has also given protection from arrest to Setalvad and her husband till February 19.

A day ago, the apex court had stayed the arrest of Teesta Setalvad and her husband, soon after Gujarat High Court rejected their anticipatory bail plea.

Senior advocate Kapil Sibal had orally mentioned about the imminent arrest of the couple, soon after Gujarat High Court rejected their anticipatory bail.

The couple had rushed to the apex court within an hour of the High Court dismissing their plea for a stay on its order to allow them time to move the Supreme Court.

Setalvad and her husband have been booked by the Crime Branch of Gujarat Police on charges of cheating, breach of trust and under the IT Act, in a matter relating to the construction of "Museum of Resistance" in the Gulbarg society in Ahmedabad which was hit by communal riot in 2002.

Meanwhile, Congress leader Manish Tewari said activist Teesta Setalvad had played an important role in exposing the perpetrators of Gujarat pogrom and bringing them to justice and added that the steps taken against her were out of a sense of political vendetta.

"The fact remains that Teesta Setalvad played a very seminal role in exposing the perpetrators of the Gujarat pogrom and bringing them to justice. It's quite obvious that whatever steps have been taken against her, they are out of a sense of political vendetta," Tewari said.

Delhi: Parties condemn incident of vandalism at Christian school

New Delhi: Cutting across party lines, leaders on Friday denounced the alleged vandalisation of a prominent Christian school in South Delhi with Aam Admi Party saying both the Centre and the state have to think about how to prevent such "unacceptable" incidents.

"This is an incident which cannot be accepted. Society can't stand like this. Everyone has to think
about this including the Centre and the state," AAP leader Manish Sisodia told reporters here. "Something needs to be done about it because such incidents have been continuously increasing. It can't be left as a small incident.... People belonging to a religion are praying and others who are not following it are throwing stones at them.

"Let tomorrow's programme happen. We will discuss this with police that how such actions can be controlled because society needs to be kept together. If it is divided then it is a danger for the nation," he said.

The AAP government will be sworn in here tomorrow. Congress leader Arvinder Singh Lovely also condemned the incident saying, "It is a matter of deep concern the way minorities are being attacked continuously. It shows the failure of police and government in maintaining law and order situation."

Another Congress leader, Shobha Jha, said, "It is unfortunate that this is fifth such incident of an attack on minorities, church or schools being ransacked and the government is sleeping." "It is unfortunate that no arrest has been made in the last attack despite people of Christian community protesting against it. This shows the government is insensitive towards security of minorities," she added. Prime Minister Narendra Modi today summoned Delhi Police Commissioner B S Bassi in the wake of the incident and directed him to come down hard against those involved in such attacks.

BJP's spokesperson Sambit Patra, however, said that the incident should not be viewed in religious context. "I don't think this is a targeted attack on a community. The principal has also come to the forefront and maintained that no religious item was attacked and it's a case of theft. Even police commissioner has come out with the same comments on the matter. I think it's unfair to mix religion into every issue," he told reporters. Unidentified persons had allegedly vandalised the school in South Delhi's Vasant Vihar in the wee hours today even as police and school authorities claimed it to be a case of robbery.

PM Modi sending Foreign Secretary Jaishankar to Pak soon since calling off talks over Kashmir

New Delhi: Prime Minister Narendra Modi is sending Foreign Secretary Subrahmanyan Jaishankar to Pakistan as part of a regional tour, the first top-ranking visit since Modi broke off talks last year over the disputed region of Kashmir.

The sign of a thaw in ties comes weeks after a visit to India by US President Barack Obama.

The United States has long privately encouraged dialogue between India and Pakistan hoping that better ties between the nuclear-armed neighbours could lead to cooperation in other areas such as Afghanistan.

Modi called his Pakistani counterpart, Nawaz Sharif, early on Friday to wish his country luck in the World Cup cricket tournament beginning this weekend and to tell him that Jaishankar will soon visit Islamabad as well as other regional capitals.

The Indian government last year abruptly called off talks between the foreign secretaries, incensed that Pakistan`s envoy in New Delhi had hosted Kashmiri separatists in the run-up to those talks.

India considers the whole of Kashmir as an integral part of the country and the decision by Modi`s government to pull the plug on talks with Pakistan represented a stiffening of India`s stand on the 68-year-old dispute over the territory.

Pakistan criticised the decision to cancel the talks and there have since been calls, including from within India, that the two countries must remain engaged.

Sharif told Modi that he welcomed the proposed visit of the Indian envoy to Pakistan to discuss all issues of common interest, the Pakistani foreign office said in a statement.

The neighbours have fought two wars over Kashmir since independence from Britain in 1947 and ties remain difficult since a 2008 attack on Mumbai by Pakistan-based gunmen.

India wants speedy trials of those suspected to have orchestrated the attacks. Pakistan says it is doing all it can.

Modi said in a Twitter post that he called the leaders of Afghanistan, Bangladesh and Sri Lanka, besides Pakistan to wish them luck in the cricket tournament being held in Australia. India play Pakistan in their opening game on Sunday.

Pics: Peshawar: Blast outside Shiite mosque; 20 killed, 55 injured




At least 20 people were killed and over 55 others injured when Pakistani Taliban militants attacked a Shia mosque in Peshawar city during Friday prayers, police and hospital officials said.

The Tehreek-e-Taliban Pakistan (TTP) claimed responsibility for the attack, Dawn quoted citing an email sent by the group.

Heavy firing was also reported and residents said a thick cloud of smoke engulfed the Hayatabad area of the city.

Residents said three explosions took place inside the Imamia Masjid at the time of Friday prayers.

The attack comes two weeks after a suicide bombing at a Shia mosque in Shikarpur in Sindh province killed over 6o people, the deadliest sectarian incident to hit the country in nearly two years.

The Muttahida Majlis Wahdatul Muslimeen (MWM), Shia Ulema Council, Jaffria Alliance and Imamia Rabita Council have announced a three-day mourning.

Mushtaq Ghani, information minister of Khyber Pakhtunkhwa province, called for deployment of Frontier Corps personnel, saying the mosque was very close to tribal areas, which made access for terrorists easy.

A police and army personnel-led operation at the mosque after the militant attack ended with the officials saying that one of the suicide bomber's jacket had been defused.

Shia scholar Arif Hussain said there was no one to control terrorists, adding that these attacks would continue if they are not brought under control.

"They are enemies of the state and enemies of Islam," he said.

Khyber Pakhtunkhwa (KP) Inspector General of Police Nasir Durrani said the attackers did not enter the mosque through the main gate as security personnel were deployed there.

Ghani has confirmed that 19 people have been killed in the attack.

Hayatabad came under heavy surveillance as helicopters hovered over the area and dozens of FC troops took up position to clear the vicinity.

Prime Minister Nawaz Sharif and President Mamnoon Hussain issued strong condemnation of the incident.

Political leaders, including Pakistan Tehreek-i-Insaf chairman Imran Khan, Jamaat-i-Islami (JI) leader Sirajul Haq, and Muttahida Qaumi Movement (MQM) chief Altaf Hussain also condemned the attack.

India's annual consumer inflation accelerates to 5.11%

New Delhi: Retail inflation moved up to 5.11% in January month-on-month, measured on a new base year 2012, mainly due to dearer food items including fruits and vegetables.

In December, retail inflation based on the Consumer Price Index (CPI) was at 4.28% (recalculated with new base year). The CPI inflation in December was 5% with 2010 as base year.

The Central Statistics Office (CSO) has revised the base year to 2012 from 2010 for computing the consumer price index. After releasing the new series, Chief Statistician TCA Anant told reporters that "inflation in 2014-15 will be lower than the 2013-14 level".

He further said that besides changes in weight of items and groups, "we have shifted to geometric mean for computing inflation from arithmetic mean used in previous series."

Food inflation in January was 6.13% due to costlier fruits, vegetable and cereals. The rate of price rise in egg contracted by 0.24% in January, while the same shot up to 9.38% in milk and related products.

The government also released Consumer Food Price Index (CFPI) which stood at 6.06% on annual basis.

AIB Roast: Trouble mounts for AIB team, another FIR registered

Mumbai: In continuing trouble for the organisers and participants of the AIB Knockout show which raised the hackles of moral brigade, a court here has ordered police to register a first information report (FIR). An FIR has already been filed in Pune, while Maharashtra government has announced an inquiry.

"The complaint be sent to the police station concerned for investigation and report," said additional
magistrate C S Baviskar yesterday, in response to an application by activist Santosh Daundkar who alleged that the participants used "vulgar, obscene and pornographic" language before an audience which had a large number of women. Daundar's lawyer Aabha Singh said that the video of the show was also uploaded online and on social media.
The complaint also objected to the venue being used for entertainment show, in breach of Coastal Regulation Zone rules.

"The place was designated primarily for sports activities but... a commercial, vulgar, obscene and pornographic show comprising several Bollywood personalities was held at the SVP stadium at National Sports Club of India in Worli in South Mumbai on January 20," it said.

The complaint named Jayantilal Shah, president of NSCI; Ravinder Agrawal, secretary of NSCI; Bollywood celebrities Karan Johar, Ranveer Singh, Arjun Kapoor, Deepika Padukone and Alia Bhatt, among others.
Daundkar sought registration of FIR under sections 294 (obscenity) and 509 (word, gesture, act intended to insult modesty of woman) of Indian Penal Code, as well as under the Bombay Police Act, the Environment Act and the Information Technology Act.

On Monday, the Bombay High Court had directed the government and I&B ministry to respond to a petition seeking action against organisers. The show was a comic 'roast', also called insult comedy, a format borrowed from the US. It attracted over four million views in less than four days on YouTube. 

Marathon Ukraine talks end with peace deal

MINSK, Belarus: Guns will fall silent, heavy weapons will pull back from the front, and Ukraine will trade a broad autonomy for the east for control of the Russian border by the end of the year under a peace deal hammered out Thursday in all-night negotiations between Russia, Ukraine, France and Germany 

The deal was full of potential pitfalls, however, that could derail its implementation. In announcing the plan, Russia and Ukraine disagreed over what exactly they had agreed to in marathon 16-hour talks, including the status of a key town under rebel siege. 

Russian President Vladimir Putin told reporters that the agreement envisages a ceasefire that will be effective starting from the start of the day Sunday (2200 GMT or 5 pm EST Saturday) as well as a special status for the rebel regions, provisions on border controls and humanitarian issues. 

Ukrainian President Petro Poroshenko said there was no agreement on any autonomy or federalization for eastern Ukraine, a longtime demand of Russia that wants it to maintain leverage over its neighbor and prevent it from ever joining Nato. 

The deal, however, requires the Ukrainian parliament to give wide powers to the eastern regions as a condition for restoring Ukraine's full control over the border - a provision that would be certain to trigger heated political debate in Ukraine. 

The agreement is a complex compromise that allows both Russia and Ukraine to claim victory, but it's full of potential pitfalls that may derail its implementation. Uncertainty remained even regarding the declared cease-fire, as Putin admitted that he and Poroshenko disagreed on assessing the situation in a key flashpoint, the government-held town of Debaltseve. 

"We now have a glimmer of hope," said German Chancellor Angela Merkel, who brokered the talks in the Belarusian capital together with French President Francois Hollande. "But the concrete steps of course have to be taken, and we will still face major obstacles. But on balance I can say that we have achieved gives significantly more hope than if we had achieved nothing. So one can say that this initiative was worth it." 

More than 5,300 people have died since April in the fighting, which continued to rage Thursday even as the four leaders were engaged in talks. 

The deal envisages a buffer zone to be created by pulling back the heavy artillery and rocket systems from 50 to 140 kilometers (31 to 87 miles) away from the frontline depending on their caliber. The withdrawal should begin no later than a second day after the cease-fire becomes effective and be completed within two weeks. 

In a win for Ukraine, the rebel regions, which held their own elections last fall that Ukraine and the West declared a sham, are obliged to hold a new local vote under the Ukrainian law. 

But in a key concession to Russia, the deal says the restoration of Ukrainian control over the border with Russia in rebel-controlled areas could be completed only by the end of 2015 on condition that Ukraine conducts a constitutional reform granting wide powers to the eastern regions, including the right to form their own police force and trade freely with Russia. 

Speaking to reporters after the exhausting talks, Putin said "it was not the best night in my life, but the morning, I think, is good because we have managed to agree on the main things despite all the difficulties of the negotiations." 

Hollande said he and Merkel are committed to helping verify the cease-fire process in Ukraine, hailing the deal as a "relief to Europe." 

A previous cease-fire agreed in September fell apart as Ukrainian government forces and Russian-backed rebels both tried to gain more ground. 

"We came to an agreement, an agreement on a cease-fire and on a global political settlement of the Ukrainian conflict," Hollande said. "That global settlement will include all issues, from the cease-fire to the control of the border, to decentralization, and, of course, the pullback of heavy weapons and resuming economic relations." 

Poroshenko stressed that the agreement contains "a clear commitment to withdraw all foreign troops, all mercenaries from the territory of Ukraine," a reference to the soldiers and weapons that Ukraine and the West say Russia has sent into eastern Ukraine to back the rebels. Moscow has denied the accusations, saying Russians in eastern Ukraine were volunteers, but the sheer number of sophisticated heavy weapons in rebels' possession belies the denial. 

Merkel said that, at the end, Putin exerted pressure on the separatists to get them to agree to the ceasefire. 

"I have no illusions, we have no illusions - a great, great deal of work is still necessary. But there is a real chance to make things better," she said. 

The French-German diplomatic dash came as President Barack Obama considered rising calls at home for sending US lethal aid to Ukraine, a move that the European leaders fear would only widen hostilities. 

The urgency felt by all sides appeared to be underlined by the extraordinary length and discomfort of the talks, which began Wednesday evening in the Belarusian capital and continued uninterrupted through the night as crowds of reporters waited anxiously in a marble-floored, chandeliered convention hall in Minsk. One was whisked away by doctors to be treated for exhaustion, according to the Interfax news agency. 

While the four leaders hailed the agreement, it became immediately clear that Russia and Ukraine continued to disagree on how to end fighting around Debaltseve, a key transport hub between the two main rebel-controlled eastern cities. 

Putin said that the rebels consider the Ukrainian forces surrounded and expect them to surrender, while Ukraine says its troops have not been blocked. 

The Russian leader said that the peace deal also determines a division line from which heavy weapons will be pulled back. 

The line of division and other key provisions were contained in a document endorsed by rebel chiefs and the representatives of Russia, Ukraine and the Organization for Security and Cooperation in Europe. That agreement was endorsed by the four leaders, who issued a separate declaration. 

"We were presented with various unacceptable conditions of withdrawal and surrender," Poroshenko said. "We did not agree to any ultimatums and stated firmly that the cease-fire that is announced is unconditional." 

Rebel leaders lauded the agreement and said they're willing to give Kiev another chance. "(We) give this chance to Ukraine to change its constitution, to change its attitude," rebel leaders in Luhansk Igor Plotnitsky said on Russian television. 


Donetsk rebel leader Alexander Zakharchenko said he will lay the blame on Kiev if the cease-fire collapses and that there "will be no meetings and no new agreements."

Bihar Crisis: Nitish Kumar hits out at PM Modi, accuses him of horse-trading

Patna: JD(U) leader Nitish Kumar on Thursday targeted Prime Minister Narendra Modi for "encouraging" horse-trading in Bihar and alleged that the Centre "pressured" the Governor into giving the incumbent Chief Minister a long time to prove his majority so that MLAs could be "lured".

In a frontal attack on Modi, Kumar said the "script" to what is happening in Bihar was written after Chief Minister Jitan Ram Manjhi met the Prime Minister here on February 8.

"All kinds of allurement are being made to MLAs. They are being offered ministerial chairs and even BJP tickets," Kumar said.

Kumar said "license for horse-trading" was issued in Delhi and alleged BJP's involvement. Asked if money is also being offered, he said this is being talked about everywhere.

BJP on its part rejected as malicious and baseless the allegations by its friend-turned-foe and asserted it had nothing to do with JD(U)'s internal crisis. It accused Kumar of indulging in "dirty politics" for his attack on constitutional chairs and said he should restrain his "craving for power" till February 20 when Governor Kesari Nath Tripathi has asked Manjhi to prove his majority.

Though Kumar refrained from naming Modi, Kumar made his target clear. "I am talking about the same person you are mentioning again and again," he said when asked if he was attacking the Prime Minister.

What BJP was doing was a direct attack on democratic and constitutional norms and people of Bihar will teach it a lesson similar to what voters in Delhi did, Kumar said, referring to the party's debacle in Delhi Assembly polls.
Bihar will go to polls later this year.

"First a delay (by Governor) in taking decision and then giving him (Manjhi) more time show that it is being done according to the script written in Delhi and to give adequate time to encourage horse-trading. This has been decided at the highest level." Kumar said before leaving for Patna.

"It started after Manjhi met the Prime Minister. The Governor was earlier convinced that an early floor test should be held. But things changed after Manjhi's meeting with the Prime Minister and he was pressured. The script was written here," he added.

Kumar had yesterday paraded about 130 MLAs and met President Pranab Mukherjee demanding his intervention. Leaders from RJD, Congress, Samajwadi Party and the Left had accompanied him during the meeting.

'PM Modi won't be able to attend Kejriwal's swearing-in ceremony'

New Delhi: Delhi's Chief Minister-designate Arvind Kejriwal on Thursday met Prime Minister Narendra Modi and discussed a range of issues related to the national capital including granting full
statehood.

Kejriwal, who was accompanied by senior AAP leader Manish Sisodia, reached the PM's residence around 10:30 AM and the meeting lasted for around 15 minutes.

"Arvind told the Prime Minister that both the Centre and the state government enjoy strong majority, therefore, it is a golden opportunity for both to work together to make Delhi a better city," Sisodia told reporters after the meeting.

He added that the AAP Chief also raised the issue of full statehood with the Prime Minister.

Kejirwal also invited Modi to his oath-taking ceremony at the Ramlila Grounds on February 14. However, the Prime Minister expressed his inability as he would be out of the city on that day.

Swine flu: Swiss woman dies in Jodhpur

Jodhpur: A 70-year-old woman from Switzerland on Thursday died of swine flu at a hospital in Jodhpur, an official said. Meanwhile, in Gujarat and Rajasthan 10 and 8 more persons died respectively. 

The deceased identified as Animarie succumbed to the flu this morning, Jodhpur Chief Medical and Health Officer (CMHO) Dr Y V Singh Rathore told PTI on phone.

She was referred to MMH in Jodhpur on Wednesday from a private hospital in Jaisalmer where she was found positive for H1N1 virus, he said.

The woman, who was also suffering from lung cancer, died this morning, the CMHO said. The body has been kept in a mortuary.

She had come to Jaisalmer as a tourist and the woman's guide brought her to Jodhpur yesterday.

The Swiss Embassy has been informed, the official said.

In Gujarat, ten more casualties have been reported, taking the total death toll in the state over 100, while over 150 new cases were reported in the state in the past 24 hours. The total number of such cases this year has now climbed over 1,000

Authorities in Gujarat have stepped up measures to combat the spread of the fatal H1N1 virus that causes swine flu. 

Arrangements for separate wards, beds, adequate medical supplies, including Tamiflu medicines, have been made in hospitals.

People are being educated on preventive measures and have been instructed to wear masks, wash their hands frequently, besides sanitising the environment.

In Rajasthan, eight more persons succumbed to swine flu, raising the toll of the disease- related deaths to 117, an official of the Medical and Health Directorate (MHD) said today.

Of the eight deceased, three persons were from Barmer, and one each from Jodhpur, Banswara, Jhunjhunu, Jaisalmer, and Sikar, the official said.

"Out of 1,404 people tested positive for the virus, 117 have died in the state from January 1 so far," the official said.

Of the 33 districts in Rajasthan, 29 are affected with the contagious swine flu.

So far, Jaipur has reported 21 deaths due to the H1N1 virus, maximum in the state, followed by Ajmer 19, Barmer 11, Nagaur 9, Jodhpur 8, Chittorgarh 7, Banswara 6, Kota 5, Bikaner and Tonk 4 each, Sikar and Bhilwara 3 each, Dausa, Jhunjhunu, Pali, Bundi, and Udaipur two each.

Bharatpur, Churu, Jaisalmer, Srigangangar, Hanumangarh, Dungarpur and Alwar have recorded one death each.

The swine flu toll in Maharashtra has crossed 100.

As many as 216 people have lost their lives to due the flu across the country in the first ten days of February as the death toll mounted to 407 this year. 

Swine flu is caused by the H1N1 virus. H1N1 symptoms are similar to those produced by other influenza viruses - fever, cough, sore throat, body aches and respiratory problems.

Symptoms for swine flu include high fever, headache, muscle pain, diarrhoea, vomiting, stomach pain and internal and external bleeding. It is transmitted to people primarily from ticks and livestock animals with an incubation period of up to nine days. Human-to-human transmission takes up to two weeks.

Gulbarg fund case: Supreme Court stays Teesta Setalvad's arrest till Friday

New Delhi: Supreme Court today stayed till Friday the arrest of social activist Teesta Setalvad and her husband, soon after Gujarat High Court rejected their anticipatory bail plea in a case of alleged embezzlement of funds for a museum at Gulbarg society, devastated in the 2002 riots.

A bench headed by Chief Justice H L Dattu said Setalvad and her husband Javed Anand would be protected from the arrest till the matter is heard on Friday.

Senior advocate Kapil Sibal orally mentioned about the imminent arrest of the couple, soon after Gujarat High Court rejected their anticipatory bail.

Sibal along with advocate Aparna Bhat mentioned the plea, when the bench, which also comprised justices A K Sikri and Arun Mishra, was hearing another case.

The lawyers said the police was at their doorstep and hell bent to arrest them. This is "an extraordinary situation" and therefore should be heard urgently, they said. The bench said that the appeal against the High Court decision could be filed in the course of the day.

The couple rushed to the apex court within an hour of the High Court dismissing their plea for a stay on its order to allow them time to move the Supreme Court.
The High Court also observed that Setalvad was not cooperating in the probe and "they cannot be armoured with full fledged anticipatory bail when applicant did not cooperate with the investigation."

Setalvad and her husband have been booked by the Crime Branch of Gujarat Police on charges of cheating, breach of trust and under the IT Act, in a matter relating to the construction of "Museum of Resistance" in the Gulbarg society in Ahmedabad which was hit by communal riot in 2002. 

Maken's 'style' has not helped; Congress was demoralised: Sheila Dikshit

New Delhi: Senior Congress leader Sheila Dikshit on Thursday said she 'pitied' Ajay Maken, who was the party's chief ministerial candidate for the recently held Delhi assembly polls, adding that his 'style' had not helped the grand old party.

"The signals that went from the Congress party did not inspire confidence. Although we didn't realise that we won't get even a single seat, it was clear from the beginning that we would lose badly. What can I say about Ajay Maken, except that I pity him," Dikshit told ANI. "He got the leadership and he took it... but quite obviously his style did not help the Congress,".

Spelling out the party's weaknesses, the former Delhi chief minister stated that the campaign by the Congress should have been aggressive.

"Ajay Maken was the chairman of the campaign committee; the campaign should have been aggressive. There was lack in our strategy, maybe in totality the Congress party was demoralised," Dikshit said.

"It is now Arvind Kejriwal's duty to fulfil all the 70 promises that he made," she added.

In an unprecedented first for the national capital, the Arvind Kejriwal-led Aam Aadmi Party received 67 seats out of the 70 on offer in the Delhi polls. With this extraordinary mandate, the AAP has become the first non-Congress and non-BJP party to rule the city.

The Congress, which in power in Delhi for 15 years up to 2013 and had been trying to rebuild its lost ground in the city, failed to even open its account in the polls.

The BJP, which was relying heavily on Prime Minister Narendra Modi's popularity and had brought in former IPS officer Kiran Bedi as its chief ministerial candidate to counter Kejriwal, also managed to secure just three seats.

US, Britain and France shut down embassies in Yemen following security concerns

Sanaa: The United States, Britain and France closed their embassies in Yemen over security fears as the takeover of the country by a Shi'ite Muslim militia group threatened all-out civil war.

Tens of thousands of demonstrators took to the streets of the central city of Taiz on Wednesday and hundreds more in the capital Sanaa in the largest protests yet against the Houthi movement, which overran Sanaa in September and formally took power last week.

The United States stopped work at its embassy and withdrew its diplomatic staff on Tuesday.

"Recent unilateral actions disrupted the political transition process in Yemen, creating the risk that renewed violence would threaten Yemenis and the diplomatic community in Sanaa," U.S. State Department spokesperson Jen Psaki said.

France and Britain followed suit on Wednesday, while employees of the German embassy said its mission was also getting rid of sensitive documents and would soon close.

The Houthi movement has called its moves a "revolution" and says it advanced from its traditional redoubts in northern Yemen to rid the country of corruption and economic peril. Their slogan is "Death to America" and their leader Abdel Malik al-Houthi has blasted what he calls Western meddling in Yemen.

But Houthi struck a conciliatory tone in a televised speech on Tuesday as dialogue continued among Yemeni parties who mostly oppose the Houthi decision to dissolve parliament. "It is in the interest of every power, domestic and foreign, to stabilise this country," he said.

Opponents of the Iranian-backed group, including Yemen's rich Sunni Gulf neighbours, have decried the takeover as a coup. Houthi fighters, bedecked in tribal robes and automatic rifles, were out in force manning checkpoints and guarding government buildings they control in the capital.

Gunmen shot in the air and thrusted daggers at protesters opposing their rule. In Taiz, which the Houthis do not control, huge crowds carrying banners chanted slogans against the group and called for their downfall. Fanning out into Yemen's west and center in recent months, Houthi forces advanced far south through several districts on Tuesday night according to local officials.

Leaders and Sunni tribesmen in the southern and eastern regions, which the group has yet to seize are arming themselves against their push and are in some cases making common cause with Yemeni Al Qaeda militants, leading to fears of an all-out sectarian war.

Beck doesn't deserve Grammy: Kanye West

Los Angeles: Rapper Kanye West, who crashed Beck's Grammy acceptance speech, says he was not joking and the award should have gone to Beyonce.

West's stunt at the Grammy, reminiscent of his VMA moment with Taylor Swift, was thought to be a joke initially but the rapper said he was serious as Beyonce not Beck should have won the trophy. "Beck knows that Beyonce should have won - you know that," West said. Asked if he'd ever heard of Beck before the Grammy awards show, he said, "Come on, man, I love Beck. But he ain't have Album of the Year."

Singer Shirley Manson blasted West for his stunt and said "You Make Yourself Look Small and Petty and Spoilt".

West nearly crashed Beck's acceptance speech after his 'Morning Phase' won the coveted Album of the Year Award over other albums by Beyonce, Sam Smith, Ed Sheeran and Pharrell Williams.

Stray incidents of ISIS radicalisation taken care of, says former RAW chief

New Delhi: A top security official on Wednesday sought to downplay threat of radicalisation of Indian youths by terror group ISIS, saying there were some "stray" incidents and those have been "taken care of" by security agencies.

The Officer on Special Duty to National Technical Research Organisation (NTRO) and former RAW chief, Alok Joshi, said there was no widespread influence of ISIS ideology and the "stray cases" were mainly out of "curiosity" over the radical outfit.

"I will contest the point that there is a widespread pull of ISIS (in India)... We are not in agreement with that. Now, I am not there (in RAW) but certainly when I was, we didn't see the kind of spread that people generally believed to be there (for the terror group). That is just not there," he told reporters on the sidelines of a conference to discuss counter-IED strategies by National Security Guard (NSG).

Joshi, who retired as RAW chief on December 31 and is set to take over as the NTRO Chairman on April 1, said those who were probably swayed by the ideology of the Islamic State of Iraq and Syria (ISIS), have since been taken care of.

"There is a certain curiosity element as to what ISIS is all about. But there is no sign of any great involvement (of Indian youths with ISIS)... One or two stray cases may be there... But people have been suitably cautioned, informed and assisted... This is the kind of response that is required (against the activities of ISIS). Please feel reassured on that," he said.

Joshi, however, evaded a direct reply to a question on the recent controversy over an intercept by NTRO following which the Coast Guard fired on a Pakistani fishing vessel off the Gujarat coast.

"It is very unfair to constantly cast doubt on this aspect... I can tell you that till yesterday I was a consumer of NTRO information and there was never any difficulty in giving information or interacting with NTRO at any level. "Let me assure that there are processes in place at the cutting-edge level in the agency (NTRO). This (exchange of snoop data) is not an issue at all," he said.

To questions whether the operation off the Gujarat coast on the intervening night of December 31 and January 1 was correct or whether there was an inquiry instituted to probe lapses, if any, he said to the best of his knowledge, there was "no inquiry" but "I am only an understudy as of now." 

White House calls climate change greater threat to US than terrorism

Washington: The White House says that climate change is a bigger threat to Americans than terrorism.

According to the Washington Times, speaking to reporters, White House press secretary Josh Earnest said Americans no longer face the same threat of attack that they did prior to 9/ 11, 2001, crediting the administration's efforts to degrade organisations like al Qaeda.

Earnest said that climate change was turning out to be a far greater threat for everyday Americans. He said that there were many more people on an annual basis who had to confront the direct impact on their lives of climate change, or on the spread of a disease, than on terrorism.

Earnest added that more people were directly affected by those things than by terrorism.

Kiran Bedi seeks probe by EC into the fatwa by Bukhari to support AAP

New Delhi: Kiran Bedi on Wednesday appeared to blame a "fatwa" by Shahi Imam of Jama Masjid Syed Ahmed Bukhari, appealing Muslims to support AAP, for her defeat in BJP's traditional stronghold of Krishna Nagar in East Delhi and sought a probe into it by the Election Commission.

She said the Election Commission should inquire the issue to know whether the Shahi Imam's appeal to Muslims a day before the polls had any impact on the electoral outcome.

"I want the Election Commission to inquire this. (Then only) it will be clearly known whether fatwa had an impact on the voters or not," she said.

Bedi claimed that though she was leading in the vote count, her vote share started dropping when counting of votes in a Muslim-dominated area of her constituency was taken up.

"I was told that during the vote count in Krishna Nagar, I was leading but when the counting of votes of the area, where fatwa might have an impact, was carried out, it started to drop," Bedi said, adding "I lost by 2000 votes when the counting reached that area."

A day ahead of the polls on February 7, Bukhari appealed to Muslims to vote for AAP but the party promptly rejected the offer. Though it was an appeal by Bukhari, several BJP leaders called it "fatwa".

Bedi said a "complete study" should be done whether there was an impact of the "fatwa" on the freedom of choice in voting.

"Fatwa means a diktat, a directive, it also means a hukumnama in a way. EC should examine whether fatwas issued last minute before the elections are good for democratic process or not," added Bedi.

AAP's S K Bagga defeated Bedi by a margin of 2,277 votes in Krishna Nagar which had stood by BJP even during the 15 years of Congress rule under Sheila Dikshit.

Kejriwal hits Delhi road running, lists 4 must-do things before Modi govt

New Delhi: A day after leading his party to a landslide victory in Delhi Assembly polls against the mighty Bharatiya Janata Party (BJP), Aam Aadmi Party (AAP) chief minister-designate Arvind Kejriwal today met Union Urban Development Minister Venkaiah Naidu and discussed various issues with him including that of unauthorised colonies in the city and full statehood.

He was accompanied by Aam Aadmi Party leader Manish Sisodia. “We have discussed four big issues with the minister. Firstly, the issues of the poor such as compensation for them, we will need central government’s help in that. Secondly, the issue of unauthorised colonies on which the Centre recently passed a resolution. So in order to take it forward help will be needed from MCD, DDA and the Centre,” Sisodia told reporters after the meeting.

“We told him that for more schools, colleges, hospitals and parking, a lot of land will be needed so whatever land is available with DDA, we have requested for it.
“And lastly the issue of full statehood. We have been fully assured that without any political divide we will get their support,” he added. Kejriwal is slated to meet President Pranab Mukherjee and Union Home Minister Rajnath Singh later in the day.

The Union Minister congratulated Kejriwal and Sisodia on their victory and also reminded them of the responsibility on their shoulders. “AAP leaders Arvind Kejriwal and Manish Sisodia met me and discussed about regularisation of unauthorised colonies and other land-related issues. I congratulated them on the victory and reminded them of the great responsibility on their shoulders,” Naidu told reporters.
“I assured him that the Centre is willing to cooperate with the state and contribute to overall interest of people and development but the cooperation will depend on your operation. As the PM has given us guidance that we have to work as a team, we will help them as per the norms.

“If you perform well, we will extend all our support. There is no question of any political consideration whatsoever,” he said.  Kejriwal also extended an invitation to Naidu for the swearing-in ceremony on February 14 at Ramlila Maidan. “He invited me but I have a prior commitment in Kolkata. I have a municipal commissioners meeting which was fixed a month back so I expressed my inability, otherwise I would have been happy to attend that,” said Naidu.

Narendra Modi govt encouraging horse-trading of MLAs in Bihar: Nitish Kumar

New Delhi: Janta Dal (U) leader Nitish Kumar, who will present over 130 MLAs before the President this evening to show that he enjoys majority support in the Bihar Assembly, accused the Modi government of encouraging “horse-trading” of MLAs in the state and alleged collusion by the Governor.

The former Bihar Chief Minister, who has been elected the JD(U) Legislature Party Leader in place of Chief Minister Jitan Ram Manjhi, said it was obvious that a majority of MLAs supported him and alleged that the delay by Governor Keshari Nath Tripathi in taking a decision was to hamper the formation of a new government.

Kumar arrived here from Patna yesterday evening, along with the MLAs supporting him, in two commercial flights.
He is scheduled to meet President Pranab Mukherjee at 7 P.M., accompanied with party president Sharad Yadav, RJD chief Lalu Prasad and SP supremo Mulayam Singh Yadav.

“The way a decision is being delayed is a clear indication that purchasing of MLAs is being done at the behest of the Centre. Intention is clear and this is to not allow formation of the majority government. We will tell the President that this will only encourage horse-trading,” he told reporters.

Kumar said his party and allies will impress upon the President on the need to take a quick action in the matter. Delaying the matter is only adding to the uncertainty and vitiating the political atmosphere in Bihar, he said.

Kumar had staked claim before Tripathi on February 9 to form a government even though incumbent Manjhi, who has been sacked from the party, insisted that he too enjoyed support of a majority of MLAs.Whatever is happening in the state is against democratic and constitutional norms, he said.

In the leaked pictures, the woman is seen bearing almost everything and taking sleazy pictures of hers mostly in washroom.

A prominent face in Bollywood as well as down South, the actress has been a part of many industries including Telugu, Tamil, Malayalam and Bengali films. She also featured in Riteish Deshmukh's Marathi blockbuster "Lai Bhaari".

While, some speculate that the leaked naked pictures are real, others believe it's a handiwork of some miscreants attempting to tarnish her image.

Incidentally, Apte has some big films lined up for release this year. Modi's 'I, me, myself' style may have hurt BJP (Comment: Special to IANS)

What the Delhi poll outcome has confirmed is that theBharatiya Janata Party (BJP) can be stopped in its tracks by a determined opponent, even one not as well-entrenched as established regional parties like the AIADMK, the Biju Janata Dal or the Trinamool Congress were in their respective states in last year's general election.
In contrast to what happened in Tamil Nadu and the two other states, the BJP has been routed in Delhi by an adversary like the Aam Admi Party (AAP) which entered the fray with a lot of baggage - its hasty departure after 49 days in power in the capital last year, the boastful assertion of anarchist tendencies by its leader Arvind Kejriwal, and an economic outlook which ranged from being "Left of Left" to a claim of being sensitive to the concerns of traders since Kejriwal harked back to his 'bania' (trading community) background.
Understandably, the BJP made full use of these deficiencies with Narendra Modi urging the AAP leader to join the Naxalites (Maoists) in the jungles since he is a self-proclaimed anarchist. Earlier, the prime minister had stressed the same point by designating Kejriwal as AK-49, the automatic rifle that is a favourite of insurgents.
To buttress Modi's offensive, the BJP threw in nearly all its central ministers, headed by Arun Jaitley, and as many as 120 MPs into the campaign, a classic case of a sledgehammer being used to swat a seeming fly.
But the reason why none of it helped the ruling party at the centre will be palpable to any discerning observer. Ever since Modi'a assumption of power last summer on the basis of heady rhetoric, the ruling party has been all words and virtually no deeds. Apart from scrapping the Planning Commission, it has done precious little to fulfil its promises of a turnaround of the economy even if the initial signs are favourable considering that a seven percent growth is being forecast.
However, as Tuesday's results show, the so-called aspirational middle class has not been satisfied. It is worth remembering that today's generation is far more impatient than their forbears. They look for quick results and explanations that it takes time for the reforms to bear fruit are rejected as ineffectual quibbling.
But an inability to show results on the economic front is not the only reason for the rebuff which the BJP has suffered after its triumph in the general election and the successive victories in Maharashtra, Haryana and Jharkhand with the possibility that it might form a government in Jammu and Kashmir as well with the People's Democratic Front as a partner.
One explanation for the voters' snub to the BJP in Delhi lies in its Achilles heel of communalism, for large sections of the electorate must have been aghast that despite having come to power on the promise of development for all - sabka saath, sabka vikas - the BJP was letting the saffron extremists, including two of its MPs, Yogi Adityanath and Sakshi Maharaj, to run amok.
Apart from their divisive campaigns, what has apparently hurt the BJP is Modi's "dangerous silence", as the New York Times called it, on these Hindu extremists.
Since Modi is widely perceived as a "strong" leader, the silence has been considered strange. Even if he appears to have acted behind the scenes to rein in some of the hotheads, in addition to telling the party members not to cross the Lakshman rekha (a prescribed limit), the apprehension among the minorities have not gone away.
There is little doubt that the AAP has been a major beneficiary of this unease not only among the Muslims, but also the Christians who have been perturbed by the recent spate of attacks on churches in Delhi. Since the Congress is virtually fading away from the electoral scene, it could not avail of the minority votes, which went to the AAP.
The AAP also gained from the perception of its honesty. It's worth recalling that the Indian voter has long been looking for a person of integrity at the top, whether it was Mr Clean, V.P. Singh, in 1989, or Mr Cleaner Rajiv Gandhi in the first three years of his reign.
Now, the AAP fits the bill, especially in view of its success during its brief stint in power in curbing the police "practice" of collecting haftas or weekly allowances from petty traders and even threatening bigwigs - the Ambani brothers were named - if they insisted on high user charges on electricity and other amenities.
All these assertions, made with a touch of hauteur, made the AAP a darling of the underclass. With the minorities, too, in their catchment area and the middle class disappointed with the slow progress on the economic front, the BJP was always fighting a losing battle.
Besides, Modi's "I, me, myself" style of governance may have begun to jar on the voter. The party may have to become a great deal more moderate if it has to succeed in the next round of elections, notably in Bihar. Modi's call to Kejriwal for a tete-a-tete over tea - chai pe charcha - is probably a sign of the toning down of attitudes.
As for the AAP, it is too early to say now how it will fare outside Delhi considering that its fielding of 432 candidates in the last general election was something of a disaster since it could win only four seats. But it may have learnt its lessons from that misadventure, especially that governance matters and not a display of belligerence against all and sundry.

Boko Haram wages new attack in Niger

Niamey: Boko Haram fighters waged a new attack on Sunday in a southeastern border town in Niger,
where a blast killed at least one person and left 10 injured, witnesses and hospital sources said.

The Islamist militants launched their assault around the town of Diffa before dawn, two days after launching its first major attack on Friday in the area bordering Nigeria, witnesses said.

The cause of the deadly blast in Diffa was not immediately known, with some sources describing it as a suicide attack while others referred to a bomb or a mortar shell.

Rohtak shocker: SIT to probe rape, murder of a mentally challenged woman

Rohtak: A Special Investigative Team (SIT) has been constituted to probe the rape and murder of the 28-year-old mentally challenged woman from Nepal in Rohtak, Haryana.

Victim's body was found in a decomposed state without key organs on Wednesday. Police say sticks, stones and condoms were stuffed into her private parts.

The post-mortem report of the woman said mentioned several injuries on her private parts.

Police said the woman belonged to Vardia district of Nepal. She was undergoing treatment in Haldwani and came to Rohtak a few months back to visit her sister.
Police have already lodged a case under different sections of IPC, including murder, rape and unnatural sexual act and destruction of evidence against unknown people.
Meanwhile, civil society members from the city took out a candle light vigil to demand justice.

No arrest has been made in the case so far, but the Police say they are investigating the case and will catch the guilty soon.

The police on Saturday also announced a reward of Rs 1 lakh to whoever gives information related to the case.

Bihar crisis: Manjhi meets PM as JD (U) stakes claim to form government

New Delhi: Bihar Chief Minister Jitan Ram Manjhi, who is under sharp criticism from the Janata Dal (United) for being defiant and reluctant to step down from his post, met Prime Minister Narendra Modi at his official 7, Race Course Road (RCR) residence on Sunday evening to discuss the political situation in the state.

Manjhi, who has in the past lauded the Prime Minister for his initiatives, was in the national capital to attend the meeting of the NITI Aayog. Earlier in the day, Lok Janshakti Party (LJP) chief and Union Minister Ram Vilas Paswan had pledged his support for Manjhi, speculating that the BJP might hold a meeting with regard to the crisis. Meanwhile, Bihar Assembly Speaker Uday Narayan Chaudhary recognized former chief minister Nitish Kumar as the JD (U) legislature party leader, a day after he was elected to the post in Patna.

A delegation of leaders of the JD (U) and its allies have also reportedly submitted letters of support to the Governor's office, stating that Nitish has the support of 130 MLAs. Earlier last evening, Manjhi had called a meeting of the state cabinet, which authorised the Chief Minister to recommend the dissolution of Bihar Assembly. But this move was strongly opposed by 20 ministers loyal to his predecessor Nitish.

Manjhi claimed that only he is authorised to take a decision on dissolution of the assembly.
Manjhi had written a letter to the Bihar Governor and requested him not to accept the recommendations made by the JD (U) legislature party meeting headed by Sharad Yadav.

He also urged the Governor to remove 15 ministers from their posts with immediate effect. Adding a new twist to the entire controversy, 20 ministers on Saturday night sent their resignation to the Governor in support of Nitish. 

Kerry denies split between U.S. and Europe on Russia policy

Munich: Secretary of State John Kerry denied on Sunday that a split has emerged between Washington and Europe over how to handle Russia, after leading U.S. senators sharply criticized
Germany and other countries who oppose sending arms to the Ukraine military.

"Let me assure everybody there is no division, there is no split – I hear people trying to create one," Kerry told a security conference in Munich.

"We are united, we are working closely together, we all agree that this challenge will not end through military force. We are united in our diplomacy.” (Reuters) 

Sydney siege: Survivors tell of terror at hands of gunman

Sydney: Survivors of a 16-hour siege in a Sydney cafe on Sunday told of their terror during the deadly standoff, as a jihadist gunman threatened to kill people "one by one".

Iranian-born, self-styled cleric Man Haron Monis, 50, held 17 people hostage at the Lindt chocolate cafe in the heart of the city's financial district on the morning of December 15 before being killed when police stormed the building in the early hours of the next day.

In emotional interviews, some of the surviving hostages told Channels Seven and Nine of how Monis forced them to call emergency services to tell them his demands, and how the gunman became more frustrated as night fell.

"I literally thought he was going to shoot us so that everybody can see through the window," survivor Harriette Denny told commercial broadcaster Channel Nine. "You lose hope, thinking about your family outside, thinking there's nothing you can do to get yourself out and it's very hard," said the 30-year-old, who was pregnant at the time of the hostage crisis.

The siege horrified Australia and prompted a mass outpouring of grief that saw thousands of flowers laid near the cafe in the city's Martin Place.

Survivor John O'Brien, 82, said Monis was "ranting and raving" about Prime Minister Tony Abbott and threatened to kill everyone in the cafe. "Tony Abbott wouldn't come to the phone, he said Tony Abbott will have all your blood on his hands when I kill you all, one by one," O'Brien told Channel Seven.

The interviews, for which channels Seven and Nine reportedly paid hundreds of thousands of dollars, came just over a week after an inquest opened into the siege.

Government reveals details of Indo-US nuclear deal

New Delhi: Foreign suppliers of atomic reactors to India cannot be sued for the damages by victims of a nuclear accident but can be held liable by the operator who has the right of recourse, government said today releasing details of the understanding reached with the US recently. In a seven-page 'frequently asked questions' dealing with contentious issues including liability, compensation and right of recourse in case of nuclear mishap, the External Affairs Ministry said the understanding on the policy hurdles were reached after three rounds of discussions between the Indo-US Nuclear Contact Group, which met last in London, just three days before President Barack Obama arrived here on January 25. "Based on these discussions, an understanding was reached with the US on the two outstanding issues on civil nuclear cooperation, which was confirmed by the leaders (Prime Minister Narendra Modi and Obama) on January 25, 2015," the ministry said.

Asserting that the country's Civil Liability for Nuclear Damages (CLND) Act "channels all legal liability for nuclear damage exclusively to the operator", the MEA said, "concerns" over the broad scope of Section 46, pertaining to possible actions under other laws, have been raised by suppliers, both domestic and foreign and clarified that this section "does not provide a basis for bringing claims for compensation for nuclear damage under other Acts." The ministry further said this Section applies exclusively to the operator and does not extend to the supplier was confirmed by the Parliamentary debates at the time of the adoption of the CLND Act.

"It may be noted that the CLND Bill was adopted by a vote. During the course of the vote on various clauses of the Bill, in the Rajya Sabha two amendments were moved for clause 46 that finally became Section 46 of the CLND Act that inter-alia sought to include suppliers in this provision. Both those amendments were negatived. A provision that was expressly excluded from the statute cannot be read into the statute by interpretation," it said. "At the same time it does not create the grounds for victims to move foreign courts. In fact that would be against the basic intent of the law to provide a domestic legal framework for victims of nuclear damage to seek compensation. The fact that a specific amendment to introduce the jurisdiction of foreign courts was negatived during the adoption of the CLND Bill buttresses this interpretation," it further added.

The ministry also rejected suggestions that there was no 'right of recourse' for an operator against foreign suppliers, saying the Section 17 of CLND provides right of recourse. "While it provides a substantive right to the operator, it is not a mandatory but an enabling provision" which can be included in the contract between the operator and the supplier for having a risk sharing mechanism. 

"As a matter of policy, NPCIL (Nuclear Power Corporation of India Ltd.), which is a public sector undertaking, would insist that the nuclear supply contracts contain provisions that provide for a right of recourse consistent with CLND Rules of 2011," MEA said.

Justifying setting up of the insurance pool of Rs 1,500 crores, the ministry said there were about 26 insurance pools operating around the world in countries such as France, Russia, South Africa and the US. The India Nuclear Insurance Pool has been instituted to facilitate negotiations between the operator and the supplier concerning a right of recourse by providing a source of funds through a market based mechanism to compensate third parties for nuclear damage. It would enable the suppliers to seek insurance to cover the risk of invocation of recourse against them.

"The Pool envisages three types of policies, including a special suppliers' contingency policy for suppliers other than turn key suppliers. Operators and suppliers instead of seeing each other as litigating adversaries will see each other as partners managing a risk together. This is as important for Indian suppliers as it is for US or other suppliers," MEA said. An international workshop will be held in New Delhi to exchange information on international experience with the insurance pools.

The government also rejected the contention that all the financial burden of the compensation was passed to the tax payer, saying, "It should be understood that there is no extra burden on the taxpayer or the Government." The CLND Act already requires NPCIL (Operator) to maintain a financial security to cover its maximum liability for civil nuclear damage (Rs 1500 crores), the MEA said, adding currently, it takes out a bank guarantee for this amount against which it pays an annual fee.

With the India Nuclear Insurance Pool (INIP), a market based international best practice will be followed and the NPCIL will take out insurance under the Pool for the same amount and just as it pays an annual fee now it will pay an annual insurance premium to the Pool, it added. The Government will make available Rs 750 crores to the Insurance Pool for the first few years till the insurance companies are able to maintain it on their own. 

On maximum amount of liability, the ministry said that in respect of each nuclear incident there shall be the rupee equivalent of 300 million Special Drawing Rights (SDRs). "As the current value of 1 SDR is about Rs 87, three hundred million SDRs are equivalent to about Rs 2,610 crores. Section 6(2) of the Act lays down that the operator's maximum liability shall be Rs 1,500 crore. In case the total liability exceeds Rs 1,500 crores, as per the CLND Act, this gap of Rs 1,110 crores will be bridged by the Central Government. Beyond Rs 2610 crores, India will be able to access international funds under the CSC once it is a party to that Convention," it noted.

With India committed to ratify the international Convention of Supplementary Compensation (CSC) for nuclear damage at the earliest, India will be able to access international funds under it also.

Country's liability law also provides that the Central Government may establish a "Nuclear Liability Fund" by charging such amount of levy from the operators, in such manner, as may be prescribed. The move may result in a nominal increase of 2 to 5 paise per electricity unit to the consumer, according to sources. "The constitution of a Nuclear Liability Fund has been under consideration for some time. Such a Fund is proposed to be built up over 10 years by levying a small charge on the operators based on the power generated from existing and new nuclear plants. This is not expected to affect the consumer’s interests," the ministry said.

The ministry also ruled out any question of possible enhancement of the amount of compensation in the Act in future and its effect on recourse against suppliers with respect to existing contracts, saying there was well established jurisprudence that a change in law cannot alter the terms of an existing contract made under the then extant law. "A retrospective law which affects the substantive vested rights of a Party under a contract would not be sustainable in a court of law," it added.

The MEA paper came in the backdrop of suggestion by various commentators that government had conceded the interests of tax payers to break the seven-year-old logjam in the Indo-US nuclear deal.
